  1. Customers and sales area

We sell to customers in the Netherlands and Belgium. We may also sell to customers in other European countries where delivery and product availability permit. Some products, including batteries and home energy storage products, may be subject to shipping, installation, safety, or regulatory restrictions in certain locations.

  1. Products and product information

We describe our products as accurately as possible. Product images, dimensions, technical specifications, compatibility information, battery capacity, installation examples, and app features are provided for information only. Before ordering, always check whether a product is suitable for your home, electrical installation, local regulations, and intended use.

  1. Orders and formation of the agreement

Your order is an offer to purchase the selected products. An agreement is formed when we accept your order by confirming it or shipping the products. We may refuse or cancel an order if a product is unavailable, information on the website contains an obvious error, payment has not been completed, or delivery is not reasonably possible.

  1. Prices and taxes

Prices are shown in euros. Unless stated otherwise, consumer prices include VAT where applicable. For products currently sold through our website, we do not charge standard shipping costs for delivery in the Netherlands and Belgium. If exceptional delivery costs apply, they will be shown during checkout before the order is placed.

  1. Payment

The available payment methods are displayed during checkout. Payment must be completed before we process and ship your order, unless we expressly agree otherwise in writing.

  1. Delivery

Delivery times stated on the website for deliveries in the Netherlands and Belgium are estimates. We will make reasonable efforts to deliver within the stated period, but delivery may be affected by stock availability, carrier delays, product dimensions, battery transport requirements, customs, or local restrictions. Risk in the product passes to you when the product is delivered to you or to a person designated by you.

  1. Right of withdrawal and returns

If you are a consumer in the Netherlands, Belgium, or another European Union country, you generally have the right to withdraw from an online purchase within 14 days after receiving the product, unless a statutory exception applies. Products must be returned complete, unused insofar as reasonably possible, safely packaged, and with all accessories and manuals. You are responsible for handling the products carefully during the withdrawal period.

For products containing batteries or electrical components, follow our return instructions before sending the product back. Some carriers apply special transport regulations to batteries.

  1. Refunds

When you validly withdraw from a purchase, we will refund the eligible amounts using the same payment method used for the original transaction, unless otherwise agreed. We may withhold the refund until we have received the returned product or until you provide evidence that you sent it back, whichever occurs first.

  1. Warranty and conformity

Consumers have statutory rights when a product does not conform to the agreement. Some products may also include a commercial manufacturer's warranty. A commercial warranty does not limit your statutory rights. Warranty claims may be refused where damage results from misuse, incorrect installation, unauthorised repair, unsuitable electrical conditions, water or impact damage, or use contrary to the manual.

  1. Installation and safety

Home energy storage products and battery systems must be used in accordance with the applicable manual, safety instructions, and local regulations. Where professional installation or inspection is required or recommended, you are responsible for arranging this with a qualified person. We are not responsible for damage caused by incorrect installation, misuse, or failure to follow safety instructions.

  1. Complaints

If you have a complaint, contact us at info@feniksenergy.com. Include your order number, a clear description of the problem, and any relevant photos or documents. We aim to respond within a reasonable period.

  1. Limitation of liability

Nothing in these terms and conditions limits your mandatory consumer rights. To the extent permitted by law, we are not liable for indirect loss, loss of profit, loss of business, or damage caused by incorrect installation, misuse, unauthorised modifications, or failure to follow product instructions.

  1. Privacy and cookies

Our processing of personal data is explained in our Privacy Policy. Our use of cookies and similar technologies is explained in our Cookie Policy.

  1. Applicable law

These terms and conditions are governed by Dutch law, without limiting any mandatory consumer protection rights applicable in your country of residence.

We may update these terms and conditions from time to time. The version published on this website at the time of your order applies to that order.
